1. Application & Your Rights
Please read these General Terms and Conditions carefully before purchasing goods on the website www.zoggs.com. By purchasing goods from this website for delivery in New Zealand, you agree to these General Terms and Conditions.
1.1 These Terms apply only to consumer purchases for personal, domestic or household use. They do not apply to business, resale or commercial buyers.
1.2 Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (CGA) or the Fair Trading Act 1986 (FTA).
2. Ordering & Contract Formation
2.1. We deliver orders within New Zealand only. The order process via our online shop consists of several steps: (i) selection of goods; (ii) provision of billing and shipping details; (iii) selection of payment method; and (iv) final confirmation. You may review and correct your details before confirming your order by clicking "Buy Now". By placing your order, you also agree to our Privacy Policy.
2.2. Your order constitutes an offer to purchase. An automatic order confirmation acknowledges receipt but does not constitute acceptance. Acceptance occurs upon shipment confirmation or dispatch of goods. You will receive a delivery confirmation email including order details, payment confirmation, and customer service information. Partial shipments may occur; in such cases, a contract applies only to items confirmed in the delivery notification.
2.3. If we cannot fulfil your order in full, we will notify you by email and – if you wish – arrange a refund or offer alternatives.
2.4. You must ensure that all information provided is accurate and complete. We reserve the right to cancel or review any order without providing reasons.
3. Your Account
3.1. You may checkout as a guest or create a Zoggs account. If you register, your information is stored securely and can be reused for future purchases. Account holders have access to order history and profile settings.
3.2. You are responsible for keeping your password secure and for all activity on your account. Notify us immediately of any unauthorised use.
4. Pricing & Payment
4.1 All prices are in New Zealand dollars (NZD) and include GST.
4.2 We accept: Visa, Mastercard and PayPal.
4.3 Payment is taken in full at the time of order. If payment fails or is reversed, we will cancel your order.
5. Shipping & Delivery
5.1 Standard Shipping
• Free for orders over NZD $120
• Flat NZD $12 for orders under NZD $120
5.2. We dispatch orders within 24–48 hours of receiving them. Orders placed on weekends or public holidays will be dispatched on the next NZ business day.
5.3 All parcels are sent via NZ Post Economy service. Delivery typically takes 3 working days for urban addresses, South Island or rural/remote deliveries will take 1–2 additional working days. Shipping restrictions apply. We reserve the right to cancel any orders placed outside of our designated delivery zones.
5.4 Delivery times are estimates only. We will notify you by email if an item becomes unavailable.
6. Dispatch Notifications & Tracking
6.1 Once your order ships, you will receive a dispatch email with your NZ Post tracking number. Track your parcel at:

6.2 For the best updates, we recommend downloading the NZ Post App. If delivery fails, NZ Post will:
- Leave a “Unable to Deliver” card with collection details
- Hold your parcel at your local PostShop for collection (see tracking for hold period)
7. Risk & Title
Risk of loss or damage passes to you when the parcel is delivered. Title passes upon our dispatch.
8. Cancellations
8.1 Once an order is dispatched to our warehouse, it cannot be cancelled.
8.2 If we cancel your order (e.g. due to unavailability), we will refund you in full.
9. Returns & Refunds
9.1. Your CGA rights are additional to this policy.
9.1.1. The returns period is thirty (30) days from date of purchase. Read our returns policy here.
9.1.2. Returns must be in original condition & packaging, unworn, unwashed, with tags attached and hygiene strip applied (for Womens, Junior Girls and Kid Girls Swimsuits).
9.1.3 Zoggs covers return shipping within New Zealand.
9.2.4. Refunds are issued once we receive and inspect the returned items, using your original payment method. Shipping fees are non-refundable.
9.2.5. We do not offer direct exchanges; please place a new order for the replacement item.
10. Faulty, Damaged or Incorrect Items
If you receive a faulty, damaged or incorrect item, contact Customer Service immediately so we can arrange a replacement under your CGA rights.
11. Consumer Guarantees & Warranty
11.1. Our products carry guarantees that cannot be excluded under the CGA.
11.2. Where goods fail, and a remedy is required under the CGA, you may choose between a refund, replacement, or repair depending on the nature of the issue.
11.3 Warranty claims require proof of purchase.
11.5 This warranty does not apply to damage caused by misuse, improper care, normal wear and tear, unauthorised repairs, or tampering. However, these exclusions do not override your rights under the CGA.
12. Privacy & Data Protection
We collect and process your personal data in accordance with our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of New Zealand. These Terms are governed by the laws of New Zealand and apply solely to consumer purchases for personal, domestic, or household use. Business purchasers are not eligible to order through this website.
14. Vouchers and Promotions
Please note:
The promotional discounts will be applied against each applicable item on the order, relative to the value of the item. Should you return a discounted item, we will refund the final price you paid for the item after the discount has been applied.
14.1. Newsletter Welcome Sign-Up
Special Website Launch Offer: For a limited time only, as a website launch exclusive, the 15% Welcome Voucher can be applied to Outlet products.
VoucherEligibility: Valid for one purchase per person. This voucher is strictly redeemable in New Zealand only.
Product Exclusions: The 15% discount applies exclusively to full-price items. It cannot be used on sale, promotional, or discounted products, and cannot be combined with any other offer.
Shipping Fees: Free shipping requirements are calculated after the discount is applied. A standard shipping fee will apply if the final basket value falls below $120.
Discount Allocation: The discount is applied proportionally across each eligible full-price item in the order based on its individual value.
Returns & Refunds: If you return an item purchased with this voucher, your refund will equal the final, discounted price paid for that item.
Validity Period: The voucher is valid for 30 days from the date of issue.
